Elected Members' Code of Conduct & Registers

Code of Conduct for Council Members

The Code of Conduct for Elected Members commenced on 1 September 2013.

Pursuant to Section 7 of the Local Government (General) Regulations 2013 for the purposes of Section 63(1) of the Local Government Act 1999, the Code of Conduct for Council Members as gazetted by the Minister for State/Local Government Relations on 22 August 2013 automatically applies to Council Members effective 1 September 2013.

Council Members must comply with the provisions of this code in carrying out their functions as public officials.

Elected Members Gift and Benefit Register

For the purposes of Clause 3.10 of the code of conduct, the threshold amount governing when a gift or benefit must be registered has been gazetted at $100.

The Elected Members Gift and Benefit Register is available for inspection (without charge) at the Council Office and on Council’s Website and updated on a monthly basis.

Elected Members Allowances and Benefits Register (Section 79)

Pursuant to Section 79 of the Local Government Act 1999, the Council must keep a Register of Allowances and Benefits, in accordance with principles (if any) prescribed by the regulations, in respect of each member of the Council:

  1. the annual allowance payable to the member; and
  2. details of any expenses reimbursed by the Council under Section 77(1)(b); and
  3. details of other benefits paid or payable to, or provided for the benefit of, the member of the Council.

The Register of Members Allowances and Benefits can be inspected (without charge) at the Council Office and a copy obtained on payment of a fee fixed by Council. A copy of each monthly Register is available below.

Elected Members Register of Interests (Section 68)

Pursuant to Section 70 (a1) of the Local Government Act 1999, Council must publish the following details in relation to each member:

  1. the Member’s income sources (within the meaning of Schedule 3) or employee;
  2. the name of any political party, any body or association formed for political purposes or any trade or professional organisation (within the meaning of Schedule 3) of which the member is a member;
  3. any gifts received by the member that are required to be included in the information entered in the Register in relation to the Member.

The Register can be inspected (without charge) at the Council Office and a copy obtained on payment of a fee fixed by Council.

Elected Members Register of Conflict of Interest (Section 74(5) and 75A(4))

If a member of a Council discloses a material conflict of interest in a matter to be discussed at a meeting of the Council, the following details must be records in the minutes of the meeting and on Council’s Website:

  1. the member’s name;
  2. the nature of the interest, as described by the member;
  3. if the member took part in the meeting, or was in the Chamber during the meeting, (under an approval under subsection (3), the fact that the member took part in the meeting, or was in the chamber during the meeting.

If a member of a Council discloses an actual or perceived conflict of interest in a matter to be discussed at a meeting of the Council, the following details must be recorded in the minutes of the meeting and Council’s website:

  1. the Member’s name;
  2. the nature of the interest, as described by the member;
  3. the manner in which the member dealt with the actual or perceived conflict of interest;
  4. if the member voted on the matter, the manner in which he or she voted;
  5. the manner in which the majority of persons who were entitled to vote at the meeting voted on the matter.
